Terms of Service

1. Service description

PromptSpark is a SaaS product that helps users improve, evaluate, organize, and reuse AI prompts. It includes a web application, a Chrome browser extension, and related APIs.

PromptSpark is operated by Next Shape. References to "we", "us", or "our" refer to Next Shape.

2. Account registration

You must create an account to use most features. You can register via Google OAuth or email and password.

You are responsible for maintaining the security of your account credentials. Notify us immediately at support@promptspark.app if you suspect unauthorized access.

You must be at least 16 years old to create an account.

3. Acceptable use

You may use PromptSpark only in compliance with applicable law and in a way that does not disrupt, overload, or misuse the service.

You may not: (a) use the service to generate content that is illegal, harmful, or violates third-party rights; (b) attempt to reverse-engineer, scrape, or extract data from the service beyond what is provided through normal usage; (c) share account credentials with unauthorized parties; (d) circumvent usage limits, rate limits, or access controls; (e) use automated tools to access the service except through our published APIs.

4. Chrome extension

The PromptSpark Chrome extension operates on supported AI platforms (ChatGPT, Claude, Gemini, Perplexity, Cursor) by reading text from composer fields and sending it to our servers for processing when you initiate an action (Spark, Evaluate, or Voice input).

The extension does not read or transmit any data unless you explicitly trigger an action. It does not access browsing history, passwords, or content outside of supported AI platform input fields.

Use of the Chrome extension is subject to the same acceptable use rules as the web application.

5. Your content

You retain ownership of the prompts, text, and other content you create or store in PromptSpark ("Your Content").

By using the service, you grant us a limited license to process, store, and transmit Your Content as needed to provide the service — including sending prompt text to third-party AI providers (such as Anthropic) for enhancement and evaluation.

We do not use Your Content to train AI models. We do not sell Your Content to third parties.

6. Plans, billing, and refunds

PromptSpark offers Free, Pro, and Team plans. The Free plan includes limited monthly usage. Paid plans unlock additional features and higher limits.

Paid subscriptions are billed through Stripe on a monthly or annual basis. You are responsible for keeping payment information accurate and current.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.

We may change pricing or plan limits with at least 30 days' notice. Changes will be reflected on the pricing page or communicated via email.

7. Free tier limitations

The Free plan is limited to 25 prompt generations per month and basic storage. Free accounts that remain inactive for more than 12 months may be deleted after notice.

We reserve the right to modify Free plan limits at any time.

8. Availability and support

We aim to keep PromptSpark available and reliable, but do not guarantee uninterrupted service. Planned maintenance or third-party outages (AI provider APIs, hosting) may temporarily affect availability.

Support is provided via email at support@promptspark.app. Response times are best-effort and may vary based on plan tier.

9. Suspension and termination

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or if required by law.

You may delete your account at any time by contacting support@promptspark.app. Upon deletion, Your Content will be permanently removed within 30 days.

Sections that by their nature should survive termination (intellectual property, disclaimers, liability) will remain in effect.

10. Disclaimers

PromptSpark is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that AI-enhanced prompts will produce specific results. The quality of AI outputs depends on the underlying AI models and is outside our control.

11. Limitation of liability

To the maximum extent permitted by law, Next Shape shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

12. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands, unless mandatory consumer protection law in your jurisdiction provides otherwise.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you via email or a notice in the web application at least 30 days before the changes take effect.

Continued use of PromptSpark after the updated effective date constitutes acceptance of the revised terms.
